Superposer End User Licence Agreement

This agreement is between you and [Company legal name], [Address] ("we", "us"). It covers the Superposer app, its helper tools and the Windows compatibility runtime we provide (together, the "Software"). By installing or using the Software you accept it. If you don't accept it, don't install or use the Software, and ask for a refund under our Refund policy.
1. What Superposer is
Superposer runs Windows games that you own on Steam through the Steam app on your Mac. It sets up an isolated Windows environment per game, chooses a graphics path, and can upscale and display the game. We don't sell games. Your games, your Steam account and your Steam library stay between you and Valve.
2. Licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on Macs that you own or control, [for personal, non-commercial use], for as long as this agreement lasts. Some features need an active Plus subscription (Subscription terms); the free tier has [describe limits]. We keep all rights we don't expressly grant.
3. What you must not do
Unless the law says you may regardless of this clause (for example for interoperability, or as the licences of the open-source parts allow), you must not:
- copy, sell, rent, sub-license or share the Software, your licence or your account;
- remove or work around licence checks or subscription limits;
- reverse engineer, decompile or modify the Software's proprietary parts (this clause does not apply to the open-source components in section 6);
- use the Software to bypass, strip or emulate copy protection (DRM) or anti-cheat, to run games you don't own, or to cheat in online games. Superposer starts games through the real Steam client and never removes DRM or anti-cheat;
- use it in breach of the law or of someone else's rights, or in a way that harms our services or other users.
3a. Anti-cheat and publisher rules
Some online games ban players for running under Windows compatibility layers, translation layers or overlays, even when nothing is wrong. Superposer reports anti-cheat games and doesn't patch them, but we can't promise that a publisher will allow you to play. You use Superposer with such games at your own risk, and we aren't responsible for a ban or lost account.
4. Third-party software, accounts and your responsibilities
- Steam and its games belong to Valve and the publishers. You need your own Steam account and must follow the Steam Subscriber Agreement. Superposer is not affiliated with or endorsed by Valve. "Steam" is used only to describe what the Software works with. Other names and marks belong to their owners (Apple, Microsoft, and others).
- Apple's D3DMetal (Game Porting Toolkit). While Superposer is free, it includes an unmodified copy of Apple's D3DMetal, distributed under Apple's Game Porting Toolkit licence (non-commercial distribution only), whose text is in Settings › Licences. Apple's terms apply to it, including its use only on Apple-branded hardware. You may instead import D3DMetal from your own Game Porting Toolkit download from Apple. You are responsible for complying with Apple's terms.
- Steam bridge. While Superposer is free, it includes a Steam bridge built from Valve's public Proton source (
lsteamclient); Valve's licences (Proton's BSD licence and the Steamworks SDK licence) are in Settings › Licences and apply to it. If the included bridge doesn't match your Windows runtime, Superposer builds one on your Mac from Valve's public source code instead (and may install Apple's Command Line Tools through Apple's installer). - Bundled open-source components. The Windows runtime (Wine and its libraries, LGPL and others), DXMT, DXVK and MoltenVK are included under their own licences (Settings › Licences); the runtime's corresponding source is offered there too.
- Microsoft redistributables. For some games, Superposer downloads Microsoft runtime installers (such as DirectX or Visual C++) directly from Microsoft to your Mac, under Microsoft's terms.
- Game data and compatibility hints. Hints use facts from the Steam store, ProtonDB (ODbL) and PCGamingWiki, fetched to your Mac. They are guidance only and may be wrong.
- You are responsible for backing up your saves and data. Superposer's change journal records what it changes so you can undo it, and uninstalling removes what it added.
5. Updates
We may update the Software and the runtime to fix bugs, add features, keep up with macOS, and meet legal requirements. Some updates may be needed to keep working. [Describe update mechanism: automatic or prompted.] Where required by law, we'll keep supplying updates needed to keep the Software in conformity for the period consumers are entitled to.
6. Open-source components
The Software includes open-source components (including Wine under the LGPL, DXMT under the MIT licence, and others). Their licences, notices and corresponding source code are in the LICENSES/ folder of the runtime and at https://superposer.app/source/ (or ask source@superposer.app). Those licences apply to those components in place of this agreement where they give you more rights. The runtime is a separate, replaceable component.
7. Your data
How we handle personal data is in our Privacy policy. In short: no telemetry unless you opt in, and you decide whether to share any compatibility report.
8. Warranty
For consumers: the Software must be as described, of satisfactory quality and fit for its purpose, and nothing here limits your legal rights (including under EU and UK consumer law).
Beyond that, because the Software depends on games, Steam, macOS and Apple hardware we don't control, we provide it "as is" and don't promise it will run every game, run without errors or stay compatible with every game update. We can't guarantee any particular frame rate.
9. Liability
Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence, or for anything the law doesn't allow us to limit.
Subject to that, we are not liable for indirect or consequential loss, lost profits, lost data, or lost games or accounts. Our total liability for anything arising from the Software is limited to the amount you paid us for it in the 12 months before the claim [or EUR/USD 50 if you only used the free tier]. 10. Subscriptions and payment
Paid features are sold through our payment provider, which acts as the seller (merchant of record). Pricing, renewal, cancellation and refunds are in the Subscription terms and Refund policy, which are part of this agreement.
11. Ending this agreement
You can stop at any time by uninstalling the Software (and cancelling your subscription). We may suspend or end your licence if you materially break this agreement and don't fix it after notice (or at once if the breach can't be fixed, or is unlawful). On ending, you stop using the Software; sections that by nature should survive do. Ending doesn't affect your refund rights.
12. Changes to this agreement
We may change this agreement for good reasons (law, new features, security). We'll tell you in the app or by email [at least 30 days] before a change that is not to your advantage takes effect. If you don't accept it, you can cancel and, for the unused part of a prepaid period, get a pro-rata refund.
13. General
- Law and courts: [Governing law, e.g. State/Country] law applies, but if you are a consumer you keep the mandatory consumer protections of the country where you live and can sue there. [Courts / arbitration clause: owner decision; do not use class-action waivers in the EU/UK.]
- Entire agreement; severability; no waiver. If a part is invalid, the rest stands.
- Assignment: we may transfer this agreement to a successor of our business; you may not transfer it without our consent.
- Export and sanctions: you may not use the Software where prohibited by export or sanctions law.
